These Terms of Service govern your access to the Kontextio website (kontextio.com) and use of the Kontextio enterprise AI access and security platform. By visiting our site or using our services, you agree to these terms.

1. Definitions

  • Kontextio / We: The legal entity operating the Kontextio platform and website
  • User / You: Any individual or organization visiting the website or using the platform
  • Platform: Kontextio's enterprise AI access, security, and data connection services
  • Service: All software, API, integration, and support services provided through the platform
  • Enterprise Customer: An organization accessing the platform under a corporate subscription or license
  • Content: Text, images, logos, designs, and software components on the website

2. Description of the Service

Kontextio is a B2B SaaS platform that enables enterprise data to be connected to AI systems in a secure, controlled, and auditable way. The service includes role-based access control, audit logs, a modular connector architecture, and GDPR-aligned data processing capabilities.

Kontextio is currently in early access. During this period, the scope, features, and availability of the service may change without prior notice.

3. Acceptance of Terms

By accessing our website, completing an early access form, or using the platform, you confirm that you have read, understood, and agree to these Terms of Service, our Privacy Policy, and any applicable additional agreements.

If you do not accept these terms, you must not use the website or services.

4. Eligibility and Account Creation

  • Our services are designed primarily for enterprise users and businesses.
  • You must be at least 18 years old or act with appropriate corporate authority to access the platform.
  • You agree to provide accurate, current, and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.

5. Early Access Terms

Registration for the early access program is subject to the following conditions:

  • Early access registration does not guarantee final product access or a specific launch date.
  • Kontextio may accept or reject early access applications at its discretion.
  • Features offered during early access may be beta quality and may contain errors, interruptions, or changes.
  • Early access users may receive priority access, but this is not a commitment.
  • Pricing and conditions specific to early access may be changed with separate notice.

6. Acceptable Use

You agree not to use the services to:

  • Violate applicable law, third-party rights, or these terms
  • Attempt unauthorized access, exploit security vulnerabilities, or interfere with systems
  • Distribute malware, disrupt the service, or attempt denial-of-service attacks
  • Process or upload others' personal data unlawfully to the platform
  • Reverse engineer, decompile, or copy licensed software
  • Resell, sublicense, or provide unauthorized third-party access to the service
  • Generate misleading, unlawful, abusive, or intellectual-property-infringing content

Violation of these rules may result in suspension or termination of your account and appropriate legal action.

7. Intellectual Property

The website, platform, software, design, logo, brand, text, graphics, and all other content are owned by Kontextio or its licensors and protected by copyright, trademark, and other intellectual property laws.

  • Content may not be copied, reproduced, or distributed without prior written permission.
  • The Kontextio name and logo may not be used without authorization.
  • You receive only a limited, non-transferable, non-exclusive license to use the service.

Enterprise customers retain ownership of data they upload or connect to the platform. Kontextio does not claim ownership over customer data.

8. Privacy and Data Processing

Processing of personal data is governed by our Privacy Policy. For enterprise customers, data processing activities are carried out under a data processing agreement (DPA) and in accordance with GDPR requirements.

Kontextio processes customer data only to provide the service and does not use that data outside customer instructions.

9. Pricing and Payment

During early access, the website and waitlist registration are free. Commercial pricing, subscription plans, and payment terms for platform use are defined in a separate agreement or proposal.

  • Prices may be updated with prior notice.
  • Failure to meet payment obligations may result in suspension of service.
  • Taxes and legal deductions apply as required by applicable law.

10. Service Availability and Changes

Kontextio does not guarantee uninterrupted or error-free service. The service may be temporarily suspended due to maintenance, updates, infrastructure issues, or force majeure.

Platform features, interface, and technical infrastructure may change with notice, or without notice during early access. Material changes will be communicated to registered users by email or in-platform notification.

11. Third-Party Services and Integrations

The platform may integrate with third-party AI providers, cloud services, and enterprise software. Use of those third-party services is subject to their own terms. Kontextio is not directly responsible for the availability or content of third-party services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Kontextio shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, reputation, or business interruption
  • Damage caused by user misconfiguration or unauthorized access
  • Interruptions caused by third-party services or internet infrastructure
  • Errors arising from beta features during early access

Kontextio's total liability arising from these terms is limited to the fees paid by the user in the 12 months preceding the relevant event; for free services, liability is limited to the minimum level required by law.

13. Indemnification

You agree to indemnify Kontextio, its employees, and partners against claims, damages, and expenses (including reasonable legal fees) arising from your violation of these terms or applicable law.

14. Suspension and Termination

Kontextio may suspend or terminate your account without prior notice in cases of breach, security risk, legal requirement, or misuse of the service.

You may close your account or cancel your early access registration at any time. Upon termination, your data will be handled in accordance with our Privacy Policy, subject to legal retention obligations.

15. Force Majeure

Our obligations are suspended in cases beyond our reasonable control, including natural disasters, war, terrorism, epidemics, strikes, government actions, or failures of internet or energy infrastructure. We are not liable for delay or non-performance caused by such events.

16. Governing Law and Dispute Resolution

These Terms of Service are governed by applicable law as specified in your enterprise agreement, or otherwise by the laws of the jurisdiction in which Kontextio operates. Parties will first attempt to resolve disputes amicably. Unresolved disputes shall be submitted to the competent courts of that jurisdiction.

17. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in effect. The invalid provision shall be replaced by a valid provision that most closely reflects the parties' intent.

18. Changes to These Terms

Kontextio reserves the right to update these Terms of Service at any time. The current version is always published on this page. Material changes will be communicated to registered users. Continued use of the service after changes constitutes acceptance of the updated terms.
